Do I really need an LPA?
Yes—if you want someone you trust to be able to act on your behalf if you become unable to. Without an LPA, your loved ones may have to go through a costly and time-consuming court process to help you, even if they are close family.
Is it too late to make an LPA?
It’s never too early or too late—as long as you still have mental capacity. We’ll help you understand what that means and whether an LPA is right for you at this stage.
Can I make an LPA even if I’m fit and well?
Absolutely. In fact, it’s best to do it while you’re well. LPAs are about planning before anything unexpected happens, not waiting until a crisis.
What's the difference between the two LPAs?
- Property & Financial Affairs: Manages your money, home, and day-to-day finances.
- Health & Welfare: Covers decisions about your care, medical treatment, and where you live.
We strongly recommend having both, as they deal with different—but equally important—areas of life.
Can my attorney take over straight away?
Only financial LPAs can be used while you still have capacity (if you give permission).
Health & welfare LPAs can only be used after you’ve lost capacity.
What happens if I don’t have an LPA?
Your family would have to apply to the Court of Protection for a Deputyship Order—a much longer, more expensive, and more intrusive process. It can take months and costs far more than setting up an LPA now.
How long does the process take?
From start to finish, including registration with the OPG, the whole process usually takes 8–12 weeks. We’ll keep you updated and ensure it’s submitted correctly.
Can you come to my home or care setting?
Yes. We offer home visits and support in care homes or hospitals. We can also work with your carer or family member to make the process easier.
Is the LPA permanent?
You can cancel or change your LPA at any time, as long as you still have mental capacity. You stay in control.
